ITW PATENT – OFFICIAL COMMUNICATION

SETTLEMENT OF PATENT DISPUTE BETWEEN ILLINOIS TOOL WORKS, INC (ITW) AND MADAG PRINTING SYSTEMS AG (MADAG)

With a contract signed March 24, 2021, ITW and MADAG globally settled a patent dispute pertaining to ITW’s patent family related to European Patent 2 236 296 B1.
Pursuant to the settlement contract, the parties agreed that MADAG discontinues with immediate effect the sale of the Decomat LS 100, Decomat LS 200 and Decomat LS 300 machines. The settlement contract applies to all countries in the world where the patent family of EP 2 236 296 B1 is in force (i.e. Belgium, Brazil, France, Germany, Great Britain, Italy, Netherlands, Spain, Turkey, USA).
With respect to the Decomat LS 100, Decomat LS 200 and Decomat LS 300 machines sold by MADAG in the past, ITW released and discharged MADAG and its customers from all claims in relation to the patent family of EP 2 236 296 B1 against a payment of a satisfactory amount. This release and discharge is only applicable to the Decomat LS 100, Decomat LS 200 and Decomat LS 300 machines that were declared by MADAG to ITW.
In light of the above, ITW invites MADAG’s customers to communicate to ITW if they own any Decomat LS 100, Decomat LS 200 and Decomat LS 300 machine acquired in the past so that they can confirm whether such product is eligible to the release under the settlement contract between ITW and MADAG. In case such machine is outside the scope of the settlement, ITW is open to find a reasonable solution.
